A Martin County Grand Jury returned the following criminal indictments on October 3, 2024.
Commonwealth of Kentucky vs. Keith Wiley
The Grand Jury charges: That on or before September 19, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Defendant committed the offense of Bail Jumping in the 1st Degree by knowingly and unlawfully having been released from custody by the court, with or without bail, upon condition that he or she will subsequently appear at a specified time and place in connection with Martin County felony charge, 24-CR-00046, he or she failed to appear at that time and place as ordered by the court, namely a Sentencing Hearing.
Commonwealth of Kentucky vs. Brett Waller
The Grand Jury charges: That on or before August 19, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Brett Waller committed the offense of Strangulation in the 2nd Degree by wantonly, without consent, impedes the normal breathing or circulation of the blood of another, applying pressure to the throat or neck of another, or by blocking the nose or mouth of another person, namely Deborah Waller.
Commonwealth of Kentucky vs. Jimmy Dale Maynard
The Grand Jury charges: That on or before September 28, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Jimmy Dale Maynard committed the offense of Strangulation in the 2nd Degree by wantonly, without consent, impedes the normal breathing or circulation of the blood of another, applying pressure to the throat or neck of another, or by blocking the nose or mouth of another person, namely Alisha Moore.
2. Jimmy Dale Maynard committed the offense of Assault in the 4th Degree when he intentionally caused physical injury to Alisha Moore of Lovely, KY.
3. The above named Defendant the offense of Terroristic Threatening in the 3rd Degree by knowingly and unlawfully threatened to commit the crime of murder and/or assault against Alisha Moore.
Commonwealth of Kentucky vs. Amos Evans
The Grand Jury charges: That on or before September 22, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Amos Evans committed the offense of Assault in the 2nd Degree by intentionally assaulting, causing physical injury to Charlotte Jude of Lovely, KY by means of a deadly weapon or dangerous instrument.
2. Amose Evans committed the offense of Strangulation in the 1st Degree by wantonly, without consent, impedes the normal breathing or circulation of the blood of another, applying pressure to the throat or neck of another, or by blocking the nose or mouth of another person, namely Charlotte Jude.
Commonwealth of Kentucky vs. Randall Bowen
The Grand Jury charges: That on or before September 1, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Randall Bowen committed the offense of Criminal Mischief in the 1st Degree by knowingly and unlawfully destroyed, damaged or defaced property owned by Kristie Nicholas of Lovely, KY, namely a 2012 Kia Rio, with damages to the vehicle totaling $4,522.24.
2. Randall Bowen, having been charged in the instant indictment with the above stated felony count, is now being charged as a Persistent Felony Offender in the 1st Degree.
3. The above named Defendant committed the offense of Unauthorized Use of Motor Vehicle by knowingly and unlawfully operating, exercising control over, or otherwise used a 2012 Kia Rio belonging to Kristie Nicholas of Lovely, KY without consent of the owner or person having legal possession thereof.
Commonwealth of Kentucky vs. John Pauley
The Grand Jury charges: That on or before September 9, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. The above named Defendant committed the offense of Fleeing/Evading 1st Degree by knowingly and unlawfully disregarding signals and commands to stop given by Deputy Justin Bellamy, Special Deputies Kirk, Diamond, Robinson and Endicott with the Martin County Sheriff’s Department, and Constables Preece and Mills while acting within their official capacity of their office and had reasonable suspicion that the Defendant had committed a crime, namely the intent to flee, avoid or elude his arrest.
2. The above named Defendant committed the offense of Wanton Endangerment 1st Degree by knowingly and unlawfully engaging in conduct which creates substantial danger of death or serious physical injury to another person, namely Deputy Justin Bellamy, Special Deputies Kirk, Diamond, Robinson and Endicott with the Martin County Sheriff’s Department, and Constables Preece and Mills.
3. The above named Defendant committed the violation of Speeding 26 mph over limit by knowingly and unlawfully operating a motor vehicle at a speed of 81 miles per hour in a 35 miles per hour speed zone, which is 9 miles over said speed limit.
4. The above named Defendant committed the violation of Reckless Driving by knowingly, unlawfully and recklessly operating a motor vehicle upon the roadways of the Commonwealth of Kentucky without due regard for the safety and convenience of pedestrians and other vehicles upon the roadways.
5. The above named Defendant committed the violation of No Registration Receipt by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway without proper registration plates as defined in KRS: 186-170.
6. The above named Defendant committed the violation of No Operators License by knowingly and unlawfully operating a motor vehicle while not having a valid operator’s license.
7. The above named Defendant committed the violation of Disregarding a Stop Sign by knowingly and unlawfully failing to properly stop at a stop sign as defined in KRS: 189.330.
8. The above named Defendant committed the violation of Failure to Illuminate Head Lamps by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway without proper illuminated head lamps as defined and required in KRS: 189.030.
Commonwealth of Kentucky vs. Danielle Pack
The Grand Jury charges: That on or before September 1, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Defendant committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a Controlled Substance, Methamphetamine.
2. Defendant committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a Controlled Substance, namely eighteen (18) dosage units of Hydrocodone.
3. Defendant committed the offense of Possession of a Controlled Substance in the 3rd Degree by knowingly and unlawfully being in possession of ten (10) dosage units of Gabapentin, a schedule IV Controlled Substance.
4. Defendant committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of two (2) altered straws, rolling papers and two (2) plastic containers with chemical residue.
5. Defendant committed the offense of Prescription Controlled Substance not in the Proper Container by knowingly and unlawfully being in possession of controlled substances not in the proper administered container.
Commonwealth of Kentucky vs. Forrest Hinkle, Jr.
The Grand Jury charges: That on or before September 1, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Defendant committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a Controlled Substance, Methamphetamine.
2. Defendant committed the offense of Operating a Motor Vehicle under the Influence of Alcohol or Drugs by knowingly and unlawfully operating a motor vehicle while under the influence of alcohol and/or drugs which impaired his ability to operate said motor vehicle.
3. Defendant committed the offense of Possession of a Controlled Substance in the 3rd Degree by knowingly and unlawfully being in possession of five (5) dosage units of Phentermine, a schedule V Controlled Substance.
4. Defendant committed the offense of Possession of Marijuana by knowingly and unlawfully possessing marijuana.
5. Defendant committed the violation of Possession of Open Alcohol Beverage Container in motor vehicle by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway while in possession of an open alcohol beverage container.
6. Defendant committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of rolling papers, and baggies.
7. Defendant committed the violation of Failure to Produce Insurance Card by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway without insurance or securities verification card as defined and required in KRS: 304.39-117.
8. Defendant committed the offense of Failure to Wear Seatbelt by knowingly and unlawfully operating a motor vehicle without having a seatbelt properly adjusted and fastened.
9. The above named Defendant committed the violation of Reckless Driving by knowingly, unlawfully and recklessly operating a motor vehicle upon the roadways of the Commonwealth of Kentucky without due regard for the safety and convenience of pedestrians and other vehicles upon the roadways.
Commonwealth of Kentucky vs. Floyd Luster III
The Grand Jury charges: That on or before September 27, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Defendant committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a Controlled Substance, Methamphetamine.
2. Defendant committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of two (2) glass pipes containing chemical residue, and a syringe.
3. Defendant committed the offense of Possession of Marijuana by knowingly and unlawfully being in possession of approximately 10.30 grams of marijuana.
4. Defendant committed the offense of Public Intoxication (Excluding Alcohol) by knowingly and unlawfully being manifestly under the influence of a controlled substance to the degree he may endanger himself or other persons or property, or unreasonably annoy persons in his vicinity.
Commonwealth of Kentucky vs. Clayton Muncy
The Grand Jury charges: That on or before February 19, 2022 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. The above named Defendant committed the offense of Fleeing/Evading 1st Degree (Motor Vehicle) by knowingly and unlawfully disregarding signals and commands to stop given by Trooper Mark Spencer with the Kentucky State Police Post #9, while acting within his official capacity and had reasonable suspicion that the Defendant had committed a crime, namely the intent to flee, avoid or elude his arrest.
2. The above named Defendant committed the offense of Fleeing/Evading 1st Degree (On Foot) by knowingly and unlawfully disregarding signals and commands to stop given by Trooper Mark Spencer with the Kentucky State Police Post #9, while acting within his official capacity and had reasonable suspicion that the Defendant had committed a crime, namely the intent to flee, avoid or elude his arrest.
3. The above named Defendant committed the offense of Wanton Endangerment 1st Degree by knowingly and unlawfully engaging in conduct which creates substantial danger of death or serious physical injury to another person, namely his father, Sean Muncy, by dragging Mr. Muncy with the motor vehicle he was operating.
4. The above named Defendant committed the offense of Criminal Mischief in the 1st Degree by knowingly and unlawfully destroyed, damaged, or defaced property, at Dempsey Housing Apartment Complex.
Commonwealth of Kentucky vs. Clancy Fields
The Grand Jury charges: That on or before September 20, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Defendant committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a Controlled Substance, Methamphetamine.
2. Defendant committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of a plastic baggie containing controlled substances.
3. Defendant committed the offense of Giving Officer False Identifying Information by knowingly and unlawfully, and with the intent to mislead a police officer as to his identity, gave a false name or false biometric identifiers to a police officer.
Commonwealth of Kentucky vs. Timothy Roberts
The Grand Jury charges: That on or before September 12, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Defendant committed the offense of Escape in the 2nd Degree by escaping front he lawful custody of the Martin County Sheriff’s Officer’s detention facility.
2. The above named Defendant committed the offense of Fleeing/Evading 1st Degree by knowingly and unlawfully disobeying a command to stop given by the Martin County Sheriff’s Department, who were acting within their official capacity and had reasonable suspicion that the Defendant had committed a crime.
