POST-ARREST COMPLAINT Charge 1: OPER MR VEH U/INFL CONT SUB (189A.010(1D) – 4TH OR >(AGG CIR) On 08/22/2026, I observed the individual seated in his vehicle at the KY-32 Dollar General with the engine running. The individual was in a silver Mitsubishi that matched the description and license plate number provided by dispatch for a suspected intoxicated driver who had left his residence on KY-32. Upon contact, the individual exhibited bloodshot eyes and slurred speech. When asked to exit the vehicle, he stated he was unable to do so due to pain and repeatedly claimed to be ill. The individual refused to perform Standardized Field Sobriety Tests (SFST) but agreed to complete the Horizontal Gaze Nystagmus (HN) test; results are below. The individual was subsequently arrested, and a search incident to arrest was conducted on the vehicle, resulting in the discovery of six vodka containers, five of which were empty and one half-full. After being read the Miranda Warning, the individual stated that the five empty containers were not his, but admitted to drinking from the half full container. He also reported taking his Suboxone prior to consuming alcohol. The individual was then transported to the Louisa Police Department for Intoxilyzer testing, during which he stated at the Police Department that he thought he was going into alcohol detox and stated that he had been drinking all day prior to driving. Intoxilyzer results- Refusal. The above was then taken to Three Rivers Medical Center and read Implied Consent Warning for his blood results refused. Horizontal gaze nystagmus tests indicate: Operator showed equal pupil size; and equal tracking. Operator did not show resting
