“…At the above date and time I received a call in reference to an angry male subject who was threatening people at Yatesville Lake from his IND. When I arrived on scene, I spoke with the reporting party who stated to me that he and his family had located a sandbar that he wanted to dock his jet ski on and allow his children to play. The above subject was fishing on his boat in the deeper area of the water when the above began to tell the reporting party that they needed to find another place to go because he was fishing there. The reporting party stated that he asked the subject if he had been catching any fish to which the above responded with curse words and threats. He stated that a brief verbal altercation happened between he and the above and they then decided to load the children up and leave. He stated that as they were leaving the above subject threw a can full of liquid at them. After speaking with them the reporting party also provided me with videos of the incident. The videos show the incident happening as the reporting party described. The above subject can be heard telling the reporting party that he will have his friends “slap them around” and stated that he would have his friends “bring a gun,” insinuating committing physical violence. Also in the video the above can be seen casting his fishing rod toward where the small children are swimming in the water. Once the verbal altercation is over, the video shows the reporting party loading the children up, attempting to leave. As they are leaving, the above subject is repeatedly cursing at them and the reporting party pulls up beside the boat and briefly stops. As they go to pull away, the above subject throws a can full of liquid at their jet ski and the liquid can be seen spilling into the water as well as the can hitting the water. The above subject is shown falling back into his boat after losing his footing due to the waves from the jet ski. After viewing the videos I determined that the above subject’s actions placed the reporting party and his family at risk of injury. I then went to speak with the above subject who stated that the reporting party began antagonizing him first. He stated that they came into his fishing spot and he was angered by the reporting party asking if he had caught any fish. He stated to me that the reporting party purposefully tried to ram into him and cause him to fall off of his boat but the videos did not show this. The above subject was advised that what the reporting party was allowed to swim in the area that they were in and he stated that he knew this. I advised that it was not a crime to ask someone if they had caught any fish. He was then placed under arrest.” –J. OSBORNE
