DEPUTY’S REPORT –T. LANEY
“…On the above date I was in my personal vehicle traveling North on Highway 23. My wife who was driving advised me that she could not pass the above vehicle because she was swerving into the other lane. I observed the above vehicle swerve over both lanes and then went off the right side of the roadway and straddled the rumble strips.
At that point advised my wife to safely go around. While passing I looked over and the above female was laying over in the passenger seat and appeared to be asleep. While passing the driver sat up and swerved toward our vehicle. I advised my wife to pull into the driveway of our home and I got into my patrol vehicle and caught up to the vehicle around Rabbit Lane.
While speaking with the above female her speech was slurred and her eyelids were heavy. She advised me that she had just been in a wreck. I asked her out of the vehicle and she had to use the vehicle to stand up. I conducted SFST and results are below.
“”I had to stop walk and turn due to subjects safety. I advised the above female she was under arrest and asked if she had anything on her person and she pulled out of her pocket a glass jar with a liquid and a bottle of pills both unlabeled. I transported the above to Three Rivers Medical and after reading implied consent she agreed to a blood draw. After the test I asked her if she wanted to contact an attorney or wanted and independent test and she advised no.
Deputy Ward arrived at Three Rivers and advised me that he just got a call on the above vehicle and advised the above female was under the influence and had wrecked out Brushy Road. I asked the above where she just came from and she advised a friends home on Brushy Road. The above was arrested for Oper Mtr Vehicle Under Influence 08/28/2025 by Boyd County Sheriff’s Deputy
Horizontal gaze nystagmus tests indicate: Operator showed equal pupil size; and equal tracking. Operator did not show resting nystagmus. Officer observed lack of smooth pursuit present in both left and right eyes; distinct and sustained nystagmus at maximum deviation in both left and right eyes; and onset of nystagmus at angle prior to 45 degrees in both left and right eyes. Operator showed 6 of 6 clues on HGN.
Walk and turn tests indicate: Operator could not maintain balance during the instructions; stopped walking; did not touch heel to toe; stepped off the line; and used arms to balance. Operator showed 5 of 8 clues on the WAT.
One leg stand tests indicate: Operator put foot down; used arms to balance; swayed; and hopped. Operator showed 4 of 4 clues on the OLS.
