A Martin County Grand Jury returned the following criminal indictments on May 2, 2024.
Commonwealth of Kentucky vs. Martin Gillespie
The Grand Jury charges: That on or before November 6, 2023 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Martin Gillespie committed the offense of Trafficking in a Controlled substance in the 1st Degree, by knowingly and unlawfully being in possession of eight (8) dosage units of a Schedule II controlled substance, Oxycodone, $1,301.59 in cash monies, with the intent to traffic in that controlled substance or by trafficking in less than ten (10) dosage units of a Schedule II controlled substance, Oxycodone.
2. That the defendant, having been charged in the instant indictment with the above-stated felony count, is now being charged as a Persistent Felony Offender, in the 1st Degree.
3. Martin Gillespie acting alone or in complicity with Tommy Booth committed the offense of Trafficking Marijuana (more than eight (8) ounces) by knowingly and unlawfully being in possession of approximately 8.42 ounces of marijuana, with $1,301.59 in cash monies, with the intent to traffic in that 8.42 ounces of Marijuana or by trafficking in the 8.42 ounces of Marijuana.
4. Martin Gillespie committed the offense of Trafficking in a Controlled Substance in the 2nd Degree, by knowingly and unlawfully being in possession of a Schedule III controlled substance, Butalbital, $1,301.59 in chas monies, with the intent of traffic in that Schedule II controlled substance or by trafficking in less than twenty (20) dosage units of a controlled substance, Butalbital.
5. Martin Gillespie committed the offense of Trafficking in a Controlled Substance in the 3rd Degree, by knowingly and unlawfully being in possession of a Schedule IV controlled substance, Alprazolam, $1,301.59 in cash monies, with the intent to traffic in that controlled substance or by trafficking in less than twenty (20) dosage units of a controlled substance, namely Alprazolam.
6. Martin Gillespie committed the offense of Trafficking in a Controlled Substance in the 3rd Degree, by knowingly and unlawfully being in possession of a Schedule V controlled substance, Gabapentin, $1,301.59 in cash monies, with the intent to traffic in that controlled substance or by trafficking in less than than twenty (20) dosage units of a controlled substance, namely Gabapentin.
7. The above-named Defendant committed the offense of Use/Possession Drug Paraphernalia by knowingly and unlawfully being in possession of a glass pipe.
Commonwealth of Kentucky vs. Tommy Booth
The Grand Jury charges: That on or before November 6, 2023 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Tommy Booth acting alone or in complicity with Martin Gillespie committed the offense of Trafficking Marijuana (more than eight (8) ounces) by knowingly and unlawfully being in possession of approximately 8.42 ounces of marijuana, with $1,301.59 in cash monies, with the intent to traffic in that 8.42 ounces of Marijuana or by trafficking in the 8.42 ounces of Marijuana.
Commonwealth of Kentucky vs. Brett Walker
The Grand Jury charges: That on or before March 2, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Brett Waller committed the offense of Fleeing/Evading in the 1st Degree by knowingly and unlawfully disregarding signals and commands to stop given by Sheriff John Kirk with the Martin County Sheriff’s Department while acting within the official capacity of his office and had reasonable suspicion that the defendant had committed a crime, namely Fleeing and Evading and a Violation of a EPO/DVO.
Commonwealth of Kentucky vs. Dylan Johnson
The Grand Jury charges: That on or before August 8, 2023 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Dylan Johnson, acting alone or in complicity with Nathan Collins committed the offense of Burglary in the 1st Degree by knowingly and unlawfully entering the dwelling house of Michael Chapman of Inez, Kentucky with the intent to commit a crime therein, while in the dwelling house or in the immediate flight therefrom was armed with a deadly weapon.
2. Dylan Johnson committed the offense of Assault in the 2nd Degree by intentionally assaulting Michael Chapman of Inez, Kentucky causing physical injury to another person by means of a deadly weapon or dangerous instrument.
3. Dylan Johnson committed the offense of Theft by Unlawful Taking over $1,000 by knowingly and unlawfully taking, or exercising control over $7,300 in cash monies from Michael Chapman of Inez, Kentucky, with the intent to deprive Chapman thereof.
Commonwealth of Kentucky vs. Nathan Collins
The Grand Jury charges: That on or before August 8, 2023 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Nathan Collins, acting alone or in complicity with Dylan Johnson committed the offense of Burglary in the 1st Degree by knowingly and unlawfully entering the dwelling house of Michael Chapman of Inez, Kentucky with the intent to commit a crime therein, while in the dwelling house or in the immediate flight therefrom was armed with a deadly weapon.
Commonwealth of Kentucky vs. Jonathan Mollett
The Grand Jury charges: That on or before December 28, 2023 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Jonathan Mullett committed the offense of Possession of a Controlled Substance in the 1st degree by knowingly and unlawfully being in possession of Methamphetamine.
2. The above-named defendant committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of an altered straw.
Commonwealth of Kentucky vs. Lisa Baisden
The Grand Jury charges: That on or before December 14, 2023 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Lisa Baisden acting alone or in complicity with Marlo Vance and Douglas Sparks committed the offense of Possession of a Controlled Substance in the 1st Degree – Fentanyl by knowingly and unlawfully being in possession of Fentanyl, a Schedule II narcotic, along with a Fentanyl test strip, and digital scales containing chemical residue.
2. Lisa Baisden acting alone or in complicity with Marlo Vance and Douglas Sparks committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a Controlled Substance, Methamphetamine, a controlled substance.
3. The above-named defendant acting alone or in complicity with Marlo Vance and Douglas Sparks committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of altered straws containing chemical residue and multiple pipes.
Commonwealth of Kentucky vs. Douglas Sparks
The Grand Jury charges: That on or before December 14, 2023 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Douglas Sparks acting alone or in complicity with Marlo Vance and Lisa Baisden committed the offense of Possession of a Controlled Substance in the 1st Degree – Fentanyl by knowingly and unlawfully being in possession of Fentanyl, a Schedule II narcotic, along with a Fentanyl test strip, and digital scales containing chemical residue.
2. Douglas Sparks acting alone or in complicity with Marlo Vance and Lisa Baisden committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a Controlled Substance, Methamphetamine, a controlled substance.
3. The above-named defendant acting alone or in complicity with Marlo Vance and Lisa Baisden committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of altered straws containing chemical residue and multiple pipes.
Commonwealth of Kentucky vs. Marlo Vance
The Grand Jury charges: That on or before December 14, 2023 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Marlo Vance acting alone or in complicity with Douglas Sparks and Lisa Baisden committed the offense of Possession of a Controlled Substance in the 1st Degree – Fentanyl by knowingly and unlawfully being in possession of Fentanyl, a Schedule II narcotic, along with a Fentanyl test strip, and digital scales containing chemical residue.
2. Marol Vance acting alone or in complicity with Douglas Sparks and Lisa Baisden committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a Controlled Substance, Methamphetamine, a controlled substance.
3. The above-named defendant acting alone or in complicity with Douglas Sparks and Lisa Baisden committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of altered straws containing chemical residue and multiple pipes.
Commonwealth of Kentucky vs. Brianna Ellis
The Grand Jury charges: That on or before January 7, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1. Brianna Ellis committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of Methamphetamine.
2. The above-named defendant committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of a syringe.
Commonwealth of Kentucky vs. Jimmy Maynard
The Grand Jury charges: That on or before January 7, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:
1 Jimmy Maynard committed the offense of Assault in the 4th Degree by knowingly and unlawfully physically assaulting Robert Cox.
