MARTIN COUNTY GRAND JURY RETURNS INDICTMENTS

A Martin County Grand Jury returned the following criminal indictments on September 5, 2024.

 

Commonwealth of Kentucky vs. Steve Marcum

 

The Grand Jury charges: That on or before August 6, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

 

1. Defendant committed the offense of criminal littering by knowingly placing or throwing litter onto a public roadway without having any permission to do so.

 

2. Defendant committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a controlled substance, namely Methamphetamine.

 

3. Defendant committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of a narcotics pipe with burn residue used to ingest controlled substances.

 

4. Defendant committed the offense of Tampering with Physical Evidence by knowingly and unlawfully concealing physical evidence that he believed would be used against him in an official proceeding.

 

Commonwealth of Kentucky vs. William Moore

 

The Grand Jury charges: That on or before July 11, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

 

1. Defendant committed the offense of Operating Motor Vehicle Under the Influence of Alcohol/Drugs 1st Degree within ten (10) years by operating a motor vehicle while under the influence of alcohol or other substances that impair a driver’s ability to operate a motor vehicle.

 

2. Defendant  committed the offense of Failure to Wear Seatbelts by transporting an adult passenger in a motor vehicle on the roadways of Kentucky while said passenger was not properly restrained by a seatbelt.

 

3. Defendant committed the offense of Operating on Suspended or Revoked Operator’s License by knowingly and unlawfully operating a motor vehicle while his operator’s license was suspended or revoked by the Commonwealth of Kentucky.

 

4. Defendant committed the offense of Possession of a Controlled Substance in the 3rd Degree by knowingly and unlawfully being in possession of a controlled substance, namely Methamphetamine.

 

Commonwealth of Kentucky vs. Ricky Goble 

 

The Grand Jury charges: That on or before July 27, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

 

1. Defendant committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a controlled substance, namely Methamphetamine.

 

Commonwealth of Kentucky vs. Chelsey Jolas

 

The Grand Jury charges: That on or before July 16, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

 

1. Defendant committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a controlled substance, namely Methamphetamine.

 

Commonwealth of Kentucky vs. Benjamin Blackburn

 

The Grand Jury charges: That on or before August 1, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

 

1. Defendant committed the offense of Bail Jumping in the 1st Degree by knowingly and unlawfully having been released from custody by the court, with or without bail, upon condition that he or she will subsequently appear at a specified time and place in connection with Martin County felony charge, 23-CR-00037, he or she failed to appear at that time and place as ordered by the court, namely a Pre-trial Conference hearing.

 

Commonwealth of Kentucky vs. Garland Mills

 

The Grand Jury charges: That on or before August 1, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

 

1. Defendant committed the offense of Bail Jumping in the 1st Degree by knowingly and unlawfully having been released from custody by the court, with or without bail, upon condition that he or she will subsequently appear at a specified time and place in connection with Martin County felony charge, 24-CR-00046, he or she failed to appear at that time and place as ordered by the court, namely a Pre-trial Conference hearing.

 

Commonwealth of Kentucky vs. Harlan Jude

 

The Grand Jury charges: That on or before August 6, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

 

1. Defendant committed the offense of Assault in the 3rd Degree by knowingly and unlawfully assaulted or attempting to assault Deputy Chris Kidd with the Martin County Sheriff’s Department, while Deputy Kidd was working within the official capacity of his office, by namely exposing the Office to saliva, vomit, mucus, blood or urine without the consent of the Officer.

 

2. The above named Defendant committed the offense of Fleeing/Evading 3rd Degree by knowingly disobeying a command to stop by Deputy Chris Kidd with the Martin County Sheriff’s Department, who had reasonable suspicion that the Defendant had committed a crime.

 

3. The above named Defendant committed the offense of Escape in the 3rd Degree by knowingly and unlawfully escaping from the Martin County Sheriff’s Department, while Officers were attempting to place him into custody.

 

4. The above named Defendant committed the offense of Resisting Arrest by knowingly, intentionally, and unlawfully attempting to prevent Deputy Chris Kidd with the Martin County Sheriff’s Department from effecting an arrest by using, or threatening to use, physical force against said police officer.

 

5. The above named defendant committed the offense of Menacing by knowingly and unlawfully placing another person, in reasonable apprehension of imminent physical injury.

 

6. The above named defendant committed the violation of Public Intoxication (Excluding Alcohol) by knowingly and unlawfully being manifestly under the influence of a controlled substance to the degree he may endanger himself or other persons or property, or unreasonably annoy persons in his vicinity.

 

Commonwealth of Kentucky vs. Bryan Moore

 

The Grand Jury charges: That on or before June 11, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

 

1. The above named Defendant committed the offense of Fleeing/Evading 1st Degree by knowingly and unlawfully disregarding signals and commands to stop given by Sheriff John Kirk with the Martin County Sheriff’s Department while acting within his official capacity of the office and had reasonable suspicion that the Defendant had committed a crime.

 

2. The above named Defendant committed the offense of Operating a Motor Vehicle on Suspended or Revoked License by knowingly and unlawfully operating a motor vehicle while his license to operate said motor vehicle had been suspended or revoked.

 

3. The above named Defendant committed the violation of Reckless Driving by knowingly, unlawfully and recklessly operating a motor vehicle upon the roadways of the Commonwealth of Kentucky without due regard for the safety and convenience of pedestrians and other vehicles upon the roadways.

 

Commonwealth of Kentucky vs. Robert Drenning

 

The Grand Jury charges: That on or before June 20, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

 

1. The Defendant committed the offense of Trafficking in a Controlled Substance in the 1st Degree (Methamphetamine) > 2 grams by knowingly and unlawfully being in possession of approximately 3.326 grams of Methamphetamine with $655 dollars in cash monies, digital scales, and individual plastic baggies, with the intent to Traffic in that Methamphetamine or by Trafficking in that controlled substance, namely 3.326 grams of Methamphetamine, while in possession of a Harrington and Richardson Brand 12- gauge shotgun.

 

2. The Defendant committed the offense of Trafficking in a Controlled Substance in the 2nd Degree by knowingly and unlawfully being in possession of 9 dosage units of a controlled substance, namely, (Buprenorphone) Suboxone, with $655 dollars in cash monies, with the intent to Traffic in that Suboxone or by Trafficking in that Suboxone, while in possession of a Harrington and Richardson Brand 12-gauge shotgun.

 

3. The Defendant committed the offense of Trafficking in a Controlled Substance in the 3rd Degree by knowingly and unlawfully being in possession of 131 and ½ units of a schedule IV-controlled substance and $655 dollars in cash monies, with the intent of trafficking that schedule II-controlled substance, namely Gabapentin, while in possession of a Harrington and Richardson Brand 12-gauge shotgun.

 

4. The Defendant committed the offense of Trafficking in Marijuana by knowingly and unlawfully being in possession of marijuana, with the intent to traffic in that marijuana, or by trafficking in that marijuana, while in possession of a Harrington and Richardson Brand 12-gauge shotgun.

 

5. Defendant committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of 5 glass pipes containing chemical residue.

 

Commonwealth of Kentucky vs. Larry Jude

 

The Grand Jury charges: That on or before August 26, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

 

1. Defendant acting alone or in complicity with Andy E. Stacy committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of 4 ½ dosage units of Oxycodone, a Schedule II Controlled Substance.

 

2. Defendant acting alone or in complicity with Andy E. Stacy committed the offense of Possession of a Controlled Substance in the 3rd Degree by knowingly and unlawfully being in possession of 4 dosage units of Gabapentin, a schedule V Controlled Substance.

 

Commonwealth of Kentucky vs. Andy E. Stacy

 

The Grand Jury charges: That on or before August 26, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

 

1. Defendant acting alone or in complicity with Larry Jude committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of 4 ½ dosage units of Oxycodone, a Schedule II Controlled Substance.

 

2. Defendant acting alone or in complicity with Larry Jude committed the offense of Possession of a Controlled Substance in the 3rd Degree by knowingly and unlawfully being in possession of 4 dosage units of Gabapentin, a schedule V Controlled Substance.

 

3. The above named Defendant committed the violation of Careless Driving by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway in a careless manner with no regard for the safety and convenience of pedestrians and other vehicles upon the roadway.

 

Commonwealth of Kentucky vs. Bryan Moore

 

The Grand Jury charges: That on or before June 11, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

 

1. Defendant committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of approximately 2.4 grams of Methamphetamine.

 

2. Defendant committed the offense of Tampering with Physical Evidence by knowingly and unlawfully destroying, removing, altering or concealing physical evidence that he believed would be used against him in an official proceeding.

 

Commonwealth of Kentucky vs. Brittany Gilmore

 

The Grand Jury charges: That on or before August 6, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

 

1. Defendant committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of Methamphetamine.

 

2. Defendant committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of 5 syringes, 2 pipes and a glass straw.

 

3. The above named Defendant committed the offense of Operating a Motor Vehicle on Suspended or Revoked License by knowingly and unlawfully operating a motor vehicle while his license to operate said motor vehicle had been suspended or revoked.

 

4. The above named Defendant committed the violation of Failure to Produce Insurance Card by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway without a proper insurance/securities card as required and defined in KRS: 304.39-117.

 

Commonwealth of Kentucky vs. Joe Allen Evans

 

The Grand Jury charges: That on or before February 26, 2024 in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

 

1. Defendant committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of approximately 49.9 grams of Cocaine, a Schedule II narcotic.

 

2. The above named Defendant committed the offense of Possession of Marijuana by knowingly and unlawfully being in possession of a plastic bag containing marijuana.
