MARTIN COUNTY GRAND JURY INDICTS TWO ON DRUG CHARGES

A Martin County Grand Jury returned two indictments on February 15, 2024.

Commonwealth of Kentucky vs. Gabriel Cooper

The Commonwealth Attorney charges: that on or before the 5th day of January, 2024, in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Gabriel Cooper committed the offense of Possession of Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a controlled substance, namely methamphetamine.

2. Gabriel Cooper committed the offense of Fleeing/Evading Police in the 2nd Degree by knowingly disobeying a command to stop by the Martin County Sheriff’s Department who were acting in their official capacity and had reasonable suspicion that the Defendant had committed a crime.

3. Gabriel Cooper committed the offense of Resisting Arrest when he intentionally prevented, or attempt to prevent, a peace officer acting under color of his official authority from effecting an arrest of the Defendant by using or threatening the use of force or violence against said peace officer.

4. Gabriel Cooper committed the offense of Use/Possession of Drug Paraphernalia by knowingly and unlawfully being in possession of a pipe used to ingest controlled substances.

Commonwealth of Kentucky vs. Earnest New

The Commonwealth Attorney charges: that on or before the 28th day of November, 2023, in Martin County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Earnest New committed the offense of Possession of Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a controlled substance, namely methamphetamine.

2. Earnest New committed the offense of Use/Possession of Drug Paraphernalia by knowingly and unlawfully being in possession of digital scales, with white residue thereupon, used to weigh controlled substances.
