Magoffin teen charged with rape of 13-year-old
A Magoffin County teen was arrested on Saturday and charged with rape and sodomy after admitting to engaging in sexual contact with a 13-year-old female.
Kentucky State Police Trooper Hale noted in the arrest citation that he received a call from the girl’s legal guardian at approximately 7:20 a.m. on Saturday, August 27, stating that Brandon Williams, 18, of Salyersville, was located inside the residence where the girl lives.
When Trooper Hale arrived, he interviewed Williams, who admitted to meeting the 13-year-old outside at approximately 2:30 a.m., at which time he entered the home. He admitted to engaging in oral sex twice and intercourse, according to the citation.
The victim told law enforcement that it was consensual sex, according to the police report. She was sent to Highlands Regional Medical Center for a sexual assault evidence collection kit.
According to KRS 510.020, a person is deemed incapable of consent when he or she is less than 16 years old.
Williams is currently charged with second degree rape (no force) and two counts of second degree sodomy, all classified as Class C felonies. Each charge carries a potential penalty of 5 to 10 years.
At press time, Williams is currently housed at the Big Sandy Regional Detention Center.
