Kentucky Senator Gary Clemons has filed two bills in the Kentucky legislative session aimed at changing how Kentucky handles cannabis.
Senate Bill 168 would put the question directly to voters, asking whether adults 21+ should be allowed limited possession and small-scale home cultivation. Clemons says the goal is letting Kentuckians decide the issue themselves.
Senate Bill 164 would remove criminal penalties for low-level possession, stop probation or parole violations based solely on cannabis, and allow certain past convictions to be expunged. Clemons argues current penalties often cause lifelong consequences that outweigh the offense.
Kentucky’s medical marijuana program began in 2025, but these proposals go further by addressing criminal justice and voter choice. Clemons says the bills aren’t about encouraging use, but about fairness, efficiency, and focusing law enforcement on serious crimes.
Both bills will be considered during the 2026 Regular Session.
