FIRED DIRECTOR HIRES ADAMS IN REGIONAL JAIL CONTROVERSY
PAINTSVILLE, KY. — On or about May 1, 2019 inmate Mark Howard from Prestonsburg, was found deceased by an apparent suicide at the Big Sandy Detention Center, but no official cause of death has been made by Johnson Co. Coroner J.R. Frisby.
The KSP in Pikeville confirmed that “they have an open death investigation” into the incident and “usually do not comment on suicides” according to KSP spokesperson William Petry.
The new Interim detention center administrator Clarence Dingus was working during this time after the firing of administrator F.D. “Pete” Fitzpatrick two weeks ago. He could not be reached for comment this morning.
TURMOIL AT THE DETENTION CENTER
This happened after a lot of changes were made at the Detention Center starting on Thursday April 18, 2019. A vote was passed by the detention center’s Board of Directors that Administrator F.D. “Pete” Fitzpatrick was suspended for 30 days, effective immediately, with his termination to happen after the 30 days. The vote was 5-4 with one member not present.
Since then the board of directors has turned some of the negative into positive solutions such as all employees have received a raise in pay.
The Detention Center has also purchased a $180,000 X-Ray machine to stop the flow of drugs being brought in by prisoners hiding contraband on or in their person.
Also, the surplus amount of money in the Detention’s bank account has been put back into the jail fund for use in making the detention center more feasible and brought up to code. In the most recent inspection overcrowding was the number one problem.
“The directors and employees are trying to turn things around for the good of employees along with inmates incarcerated,” Board Chairperson Daniel Castle said. “We hope to rehabilitate prisoners by a holistic approach instead of prisoners becoming better criminals while incarcerated, so that they may have the chance to be productive members of society.”
Castle said that he has only been on the jail board authority since January, and that the issues regarding to jail’s conditions were brought to the jail authority board attention from an Occupational Safety and Health Administration (OSHA) complaint that they received in January.
“The complaint was investigated and was founded, so the jail board took action,” according to Mr. Castle.
“I was saddened by the conditions”, he said. “It really bothers me to think we treat animals better. This place houses the sons and daughters of our counties and they should be treated better. Criminals or not, we have a duty to protect and they have an expectation to live in a safe environment.”
Chairman Castle stated that it is spelled out in the jail board policies that each cell has to be cleaned and and inspected each month and that it was Fitzpatrick’s responsibility to make sure it was done.
In a concerted effort to fix the problems at the Big Sandy Regional Detention Center, which was built in the 1980’s, Castle said they are going prison cell by prison cell, treating them for mold & mildew and painting each one of the jail cells.
“We are replacing all shower basins and shower curtains,” Castle reported. “We recently bought a $4,000 machine specifically for cleaning the cells. We are also having an inspection to the duct work done to make sure that it’s not contaminated”.
By viewing the slideshow below you can see all the disrepair and unhealthy living conditions. Mr. Castle, the board and employees are making much needed changes. And referred us to their attorney Nelson Sparks who did not return messages asking for comment.
Mr. Fitzpatrick was reached for comment but could only say, “ in Law Enforcement there is a huge turnover rate, the job is not for everyone.” He then referred us to his attorney Bud Adams, a highly successful defense attorney, also of Louisa.
There will be a public meeting held Thursday the 16, 2019 at 6pm at the old Paintsville Court House to further discuss these matters.
VOTE OF DISSENT
A lone jail authority member who voted against the firing, Joe Mills of Johnson County, said there were painting issues and mold issues. Mills said that he has been on the jail authority for almost three years and that all of the members of the jail board are new.
“Having served as President of three community colleges over my career and having hired over 5,000 people over this time, I thought that Pete (Fitzpatrick) was doing a very good job,” Mills said in email to the Big Sandy News. “Yes, there were some painting issues and some mold issues, but they were easily resolved. We just passed the state inspection with a good report.”
“I once told him (Pete) that running a multi-county jail was much more difficult than running a college. I don’t know anyone in this area who could really handle this jail and its many challenges. I understood that someone was hired to be the temporary administrator for one month (Clarence Dingus), and during this time, the position will be advertised in area newspapers. Right now, I think a really qualified applicant would be crazy to take this job because not all of the counties can pay their bills, and the jail facility building is coming apart. Walls are separating from the floors and cracks are everywhere. Our insurance carrier does not want to pay for the repairs,” Joe Mills claimed.
Jail authority members discussed F.D. Fitzpatrick’s employment Thursday, April 18, for two hours, Mills said.
“Last month, he (Fitzpatrick) was asked to make some changes, mostly painting,” Joe Mills stated. “He responded very well and he sent us pictures from week to week. At the April meeting, it was my understanding that the Jail Board would buy out 75 percent of his contract if Pete would agree to that, so they brought him back into the meeting. No one brought up the buyout. Suddenly someone made a motion of terminate him. The motion passed, but it was not unanimous. In the open meeting, someone told him to clean out his office and so Pete left the meeting to due that. He was also told that he could not take the black Ford car home with him. I think he hitched a ride with one of the Jail Board members from Martin County.”
Joe Mills said he became ill and left the meeting.
“The other matters were not significant enough to get the attention of last year’s board,” Joe Mills said. “This new board was more difficult to please.”
Joe Mills further stated that if new board members can fire a jail administrator, a school principal, a school superintendent or a community college president without providing a full due process, then anyone in those kinds of jobs should be concerned.
Joe Mills said that he had studied contract law from 1970 through 2005.
“In this day and time, you just don’t fire a professional job holder who has a contract unless that person has been given a chance to resolve the issues that the employer has against him or her,” Joe Mills remarked. “After a probationary period, a hearing should be provided, and the affected employee should be allowed to bring his/her attorney to the hearing. After the hearing is over, the Board has a right to make a decision. Our Jail Board did part of this but not all of it. When the buyout of his contract or 75% percent of it did not happen, the Jail Board’s decision to terminate his employment just opened the door to a lawsuit and depositions and more depositions.”

I, for one am glad Pete Fitzpatrick was fured and there have been more than one death at this jail since he was Warden. The conditions were deplorable, we had to beg to even get feminine hygene products and I was an inmate of this so called detention center for 38 days on principle and I won my case btw, and in a 24 hour span I had to use my nursing skills to actually save Marla Mays life , she had extremely high glucose which she had been a diabetic for years and had 5 seizures within 25 minutes and no one knew what to do so I jumpoed into and insrtructed the male guards to call for an ambulance. Later on, by the time I was released Marla was still there and died later on while still in jail. I feel this so called warden done a very poor job and should have been fired sooner.
Marla got sent to Peewee Valley a women’s prison because of her medical treatment which she later on died because she had cancer. She didn’t die at the BSRSC by the way.
Pete should have been fired along time ago.
Yes I am to a Diabetic I have been incarcerated at BSRDC several times and months at a time.It is very hard to get your meds at times.When taking insulin and have for over 30 yrs and then make a mistake getting into trouble go into BSRDC and not even see Dr for weeks and the nurses making adjustments to your meds not knowing anything about you. is something which is not a solution.I have been pepper sprayed on several occasions due to trying to get my meds.and supposed to take insulin before meals give it to you after and taking insulin drops blood sugar and have to take before meals and when in need of low blood sugar can’t get it checked unless you keep on them over and over which leads to confrontation and thrown in hole.. I think something definitely needs to be done
The jail officials might want to check into the correctional officer pay, and make sure that unemployment is being paid into, as well as workers comp. When the money is being taken out of the employees pay checks, but after termination it is discovered by the unemployment office that that employee never paid into the system, where did that money go?
I seen for myself, this jail is absolutely disgusting.. but that’s Not the worst part. The workers treat ppl awful. I had never been in trouble in my life, had to spend 3 days here over not showing for a court date..there were several women c.os that talked to me like a dog, they would say things to ppl to purposely try and get a reaction, they said many times that they love to use their pepper spray and tasers. they laughed about it and we could hear them talking to each other making bets of who they could get going most and get to spray. I didn’t react or talk back, and they continued to call me names, tell me I was trash and belittle me. For 3 days they refused to give me any of my prescribed meds, refused to let me shower and I watched them pepper spray several ppl, tie up a naked man to a chair and spray him with pepper spray then laughed! He was stuck that way all night!! I wish some under cover cops or something would go in there, see for theirselves.. its beyond bad. Those ppl should not have a job with ppl at all!!!! This jail is pathetic

I don’t think it’s 100% Pete’s fault. The jail itself has been nasty since I was there in 2007 . They had mold then & apparently still do. I have my doctors records to back up that I had some sort of mold in my lungs and thinking I was going to sue they let me out. I’m unsure how they run the jail but whoever is passing them when they come to inspect needs to be looked at. The girls cleaned the rooms everyday so they can’t say it was that. I feel it’s just to old to repair.
Thank God I have never been in jail. I have heard horror stories about jails in West Virginia and Kentucky but I suspect one could hear those same stories no matter where you go. I have had an occasion to talk to Mr. Fitzpatrick concerning “booking fee’s”. He could not provide me with any information as to whether or not booking fees are legal or required by the county or the state. I searched all the state statutes and there are no laws that require any jail to collect booking fees. A letter to Rocky Adkins was also disregarded on the same subject. Bottom line is, they cannot hold a person from being released on bond due to booking fees not being paid. I suspect this money goes directly into the pockets of the Administrator and his chosen few. It sure doesn’t appear to be used on facility maintenance.

I was in there for 3 days back in 06, it was nasty, the blanket they gave me had holes and what looked like drywall or pain hardened on it. Nasty looking shoes they wanted me to wear just thrown back in a box. I slept on the concrete in the hallway the whole time I was there.
i was in jail there for D.U.I. they put me in an over crowded drunk tank with just barley enough room to lay the thin mat they gave me down on the floor it was 16 degrees outside an not much warmer in there the thin blanket they gave me looked more like a big towel after about 2 hours they moved me and another guy to another cell that looked the same size as the first one which i would say had at least 50 inmates in it this next one only had 1 inmate i got released after 8 hours an i told them they should turn some heat on for the guys an they just laughed ! they sure wouldnt get by with treating dogs this way !
My son was arrest in January of 2018. After being there an hour they released him knowing he was under the influence of drugs . The arresting officer even told them that he believed he was high. They never even had him checked out to see if he was in an condition to be released they just let him go on a 100.00 bond. He was so high when he called a friend to tell them he was released that you couldn’t understand what he was saying. He started walking home and 2 miles from the jail my son was hit by a 80 yr old lady who had no business driving and was killed!! He was one of 3 that was released from there that was intoxicated and got hit and killed!! I believe if the officer’s at the jail had done their job my son and the orgers would be alive ! But now we have to live without him and he will never see his son grow up , graduate or see his niece’s and nephews grow up. And we are left with a big empty hole in our hearts ,lives and family. They all need to be retrained or let go .
I spent a weekend back in 2017 and it was the most horrible experience of my life . I went in with a feminine product on and had to wear it all weekend due to them not giving me another and the cell was so nasty and the toilet was leaking and they didn’t even give us mats to lay on. We had to lay on the concrete floor , I was sore for days when I got out . When I got changed out to a regular cell on the third day, which was the day of my release, the girls back there said they hadn’t got to clean their cell in at least two months and believe me it showed. And you receive one eating utensil when you go in and if you lose that you don’t get another, well of course I dropped mine in the nasty floor the first day so I couldn’t even eat my meals and I’m diabetic. I truly admit that the BSRDC is not decent enough for a animal. I would be sad to know my dog was in there . I was there for like 51 hours and did not get to bathe not one time . This experience honestly emotionally bothered me, I cried for 3 days.
Honey I had to stay there for 3months wich is 60days back in 2012 and if u didn’t buy your own your own totlit paper they’d tell u to wipe on hand and we had mold growing from the tops of our showers and doors to our bathrooms and they refused to give me my meds. And me with a heart problem that could kill me my heart doctor called that jail after my family got a hold of him and he told told them he had to redo all my blood work due to me being in such a nasty place and that if that jail didn’t have me there on time to all my heart apptments that he was going to slap a law suite in a half on them because I would die and omg when I went to see the doctor there he you all dope heads don’t want help unless you come to jail I mean really I didn’t have drivers LICENS at the time so I missed my very last appt. Because I couldn’t find a way to kindgsdaughters in Ashland my heart doctor was giveing me all the meds. I was suppost to take. You get nothing at that jail unless you have money food and all the way down to toilet paper.
Did this experience help persuade any of you to make an effort to stay out of jail? If so, you were reformed. This experience may have saved your lives. It sure looks disgusting in there. Man, I ain’t doin nuthin to get in there.
Of course not I’ve bee. In that horrible jail many times and it just teaches you to be a better criminal. They don’t have any kind of help to reform. Hell they we’re women never leave the cells unless they go to court or visitation. I think they need to have a structured environment to help people get out of the revolving doors of incarceration.
It must be lonely all of the way up there on that high horse. Praying for you to find peace and understanding without leering in judgment at the rest of us.
Betty- how very true. Most of the criminals locked up now are addicts or alcoholics who made a terrible mistake, whether suffering a mental Illness or simply horrible judgment while intoxicated. They make no effort to rehabilitate these people and in fact, the more deplorable the facility, the easier it is for the inmates to obtain drugs inside the facility. They rarely count any time spent in treatment toward your sentence and your court appointed attorney is working more for them than you. There are so many locked up with mental Illness that have no one to fight for them and no means to fight they’re just tossed to the side, being treated worse than animals. It’s unfortunate that the people able to initiate any type of change have the funds to hire an attorney to fight their battles therefore never having to spend any amount of time incarcerated.
I’m not a criminal I was in there over a dispute between me and my ex husband now, 3 days for taking up for myself and my neck cut from his fingernails,
My son is a frequent flyer there. I’m not for keeping people up in jail but i make sure he can at least take care of himself. I know parents arent up for giving their kids money while in jail but if you have one there and the jail know you are checking up on them and helping them they won’t treat them bad because they are afraid of repurcussions on the outside.
Pete Fitzpatrick is a real jerk. I called in regards to a court of issues in that jail, the main one being inmates getting beat up by other inmates and not receiving any kind of medical attention for their injuries. Also not receiving critical medication while incarcerated. He was a sarcastic, rude, smartass. And he hung up on me. Very unprofessional. I’m glad he got fired and I hope he has to work at McDonald’s from here on out
No one gets to leave the cell unless your a level 1 or if you work in the kitchen and that’s only for females. Or if the guys work in laundry or help out with commissary. I mean it’s a county jail it’s not like prison where you can have more freedom and more recreational time. By law even in a county jail all the inmates are suppose to have an hour of recreation a day but that’s weather permitting and depends on what guards is working. Some of the guards have no respect for a person treat you like a dog. Karma will get them. Or when a person gets out. – One guard is dating another guard which is not allowed. -One guard got fired because she was taking pictures with an inmate. Some of the guy guards bring in cigarettes for the guys. I think the guards needs to be checked and go through machine to check for contraband. The guys have it better than the girls. It’s a guy jail. Unless you work in the kitchen. Coming from experience. Working in the kitchen is way better than not doing anything. They have video visitation now which I think is gonna be better. I guess that is something new they started. – The jail needs so many repairs to it. It’s a filthy jail. Very nasty. Mold, on top of mold. Mice is bad especially in the kitchen. I don’t know how it ever passed the state health department. – hopefully they hire a well experience administrator.
Yeah i remember being in there for a bench warrant and took three days to get a shower then never hot a towel or wash cloth or under garments or anything . Had to dry on a piece of wool blanket and an old jumpsuit
Since you’re wanting feed back I can give you plenty. I’ve spent time there 11 months I did. Yeah some of the guards are {Censored}. So glad Pete is gone he’s a {censored}. Just as half the guys there. Get on the loud speaker talking any way they want to. In my eyes as far as female guards Red Debbie and Brittany are the best they sure did inspire me to be who I am today. The jail is nasty it’s not fit to house dogs. When you need a female guard you can’t get one until tray time or head count time. For the guys wanting someone to get in front of the camera to flash them. I was a head cook at onetime there the food is hot and fresh when it goes out the doors but then the lazy butts leave it setting in the hallways until it’s cold nasty wet from stem off the stack trays. They are so unfair as serving food the guys always get double I always thought that was so unfair. The females don’t have a chance unless family sends them money. People can say what the want about Butch but he’s the best administrator that jail ever had I don’t agree with a lot of things that went on during his time there but by gosh he did make sure the females got the same treatment as the males. The jail need only one thing tore down rebuild now that the pervert is gone.
Yes I agree 100 with these comments above I was just released back on March and when it comes to the drunk tank that you enter when you first get put in lol I would Not let my dog stay in that environment it was ridiculous 4 real the cos talk to the women in there like a dog never hardly ✔ up on u unless it’s head count or meal time mold mold mold I was sick from it for weeks when I got out my doctor said it wouldn’t take much for him to lay a lawsuit to them cause I made 6 of he’s patients came out like that..mind y’all I had 3 months which was my longest time I ever hope to spend there ever again because of child support but I somehow survived this place ..ok once you’ve made it in the back it’s stays the same the whole time I was there I didn’t get to hardly leave my cell unless for mountain comp when they came or to see the doctor which I had to beg to see btw and it took forever to see one I keep saying I was sick something wasn’t right found out I had a mini stroke while I was there..enough said if something not done with this so called Jail more ppl will die ..plan in simple!!!! Pss my close friend Brandon is in this place and still is to my knowledge I hope he’s not being treated badly because I’ve reported this place because of the way some cos treat the females so now let em laugh out of a 10 being a score for bsrdc I give it a 3 just out of the goodness of my ❤ might give it a better one on down the road if fair treatment to females and fix the cells up with Nomold I’m out
