LOUISA, KY. — Former Louisa physician Dr. Curt Edens’ attorney could not come to an agreement with prosecutors on his latest battle with the court over the use and alleged misuse of Suboxone and defrauding the state government. Here are the charges he faces now.
- 5 Counts of Complicity Theft By Deception,
- Cold checks,
- 2 counts of Complicity Present Fraudulent Claims to Defraud KMAP and
- Complicity Dispense/Prescribe/Administer Controlled Substance, 1st offense.
Edens, a popular physician in Louisa for two decades is set for another trial on May 6th, 2019 with a report date on April 12, 2019.
Six defendants were final sentenced on Friday with most sentenced to probation. At least three persons did not show up and bench warrants were issued for their arrests.
Pretrial conferences were held but no agreement was reached therefore those cases were reset for Sept. 28.
Sentencing
Roger Barnes, 33 was sentenced to 3 years on 3 different counts of
- Complicity Receiving Stolen Property,
- 3 years on Complicity Possession of a Controlled Substance, 1st offense and
- 12 months over 5 years with a Pretrial diversion.
Crystal Cordle, 46 was sentenced to amended charges as stated in the plea agreement, however agreement was not noted on docket of
- Possession Controlled Substance, 1st degree, methamphetamine,
- 1st degree Possession of a Controlled Substance, Possession of a Controlled Substance, 2nd degree,
- Tampering with Physical Evidence,
- Operating a Motor Vehicle under The Influence of Alcohol/drugs and
- Possession of Drug Paraphernalia.
Ashley Horn, 28 pled guilty and will be final sentenced on 9/28/18 to:
- 10 years for Complicity Trafficking in a Controlled Substance, methamphetamine,
- 5 years for Tampering With Physical Evidence,
- 12 months for Possession of Drug Paraphernalia and
- 90 days for Public Intox to be probated over 5 years with other conditions, concurrent but consecutive to case 2. On 2nd case the defendant received
- 5 years and other conditions in agreement with the Commonwealth for Complicity Trafficking in a Controlled Substance, methamphetamine.
Joshua Cyrus, 44 was sentenced on 2 cases. Cyrus was sentenced to
- 10 years for Assault, 2nd degree and
- 5 years of Supervised Probation over 5 years for Intimidating a Participant in Legal Process, both to run concurrent. On the second case, Cyrus received
- 3 years for Tampering With Prisoner Monitoring Device and
- 3 years for Escape, 2nd degree both cases to run concurrent. Probation Supervised for 5 years.
Kayla Hunt, 30 was sentenced to 5 years Supervised Probation for Complicity Burglary, 1st degree and Convicted Felon In Possession of a Handgun was dismissed.
Michelle Shaw, 28 (CHARGES WERE NOT PRESENT ON DOCKET) The defendant was sentenced to * 3 years on first charge,
* 30 days on 2nd and
* 180 days of In Home Incarceration with other conditions.
Arraignments and Pretrial
Johnny Moore, was arraigned on Sexual Abuse, 1st degree with victim under the age of 12 years of age.
Pretrial set for 10/19/18.
Lloyd Brown, 48 is set for trial on Feb. 4th, 2019 with a report date to try and reach a deal with prosecutors on Jan. 11th, 2019 on 2 cases.
- 1st case: Complicity Trafficking in a Controlled Substance, methamphetamine and
- Complicity Possession of Marijuana and on 2nd case:
- Complicity Trafficking in a Controlled Substance, 1st degree, and
- Trafficking in a Controlled Substance, 2nd degree,
- Complicity Trafficking in a Controlled Substance within 1000 ft. of a school and Complicity Trafficking in a Controlled Substance, 3rd degree.
William Cantrell, 34 was arraigned on
- Trafficking in a Controlled Substance, methamphetamine,
- Tampering With Physical Evidence,
- Possession of Drug Paraphernalia,
- Possession of Marijuana,
- Persistent Felony Offender, 1st degree and
- Carrying a Concealed Deadly Weapon. Pretrial will be held on 9/14/18.
Douglas Castle, 53 a hearing for Probation Revocation due to
- Complicity Trafficking in a Controlled Substance, 1st degree was reset for 1/11/19.
Dr. Curtis Edens, 59 was unable to reach a PLEA DEAL on
- 5 Counts of Complicity Theft By Deception,
- Cold checks,
- 2 counts of Complicity Present Fraudulent Claims to Defraud KMAP and
- Complicity Dispense/Prescribe/Administer Controlled Substance, 1st offense. He is set for trial on May 6th, 2019 with a report date on April 12, 2019.
Brandi Fannin, 36 was arraigned on
- Complicity Possession of a Controlled Substance, 1st degree, methamphetamine,
- Possession of Drug Paraphernalia,
- Complicity Conspiracy to Trafficking in Controlled Substance, 2nd degree,
- Possession of Controlled Substance, 3rd degree and
- Theft By Unlawful Taking or Pickpocketing under $500. Pretrial set for 9/28/18.
Todd Fitzpatrick, 23 was present for a motion to set aside bench warrant, however it remains in effect.
The defendant is scheduled for a Probation Revocation Hearing on 9/14/18.
Jeremy Fleshman, 38 was ineligible for a Diversion Completion, probation extended for one year.
Jason Hale, 38 was due to be arraigned on
- Complicity Trafficking in a Controlled Substance,1st degree and
- Complicity Trafficking in a Controlled Substance, 3rd degree. Defendant was not present and a bench warrant was issued.
April Harper, 34 was on docket to be sentenced on
- 2 cases charges of Complicity Possession Controlled Substance, 1st degree, methamphetamine,
- Complicity Possession of Drug Paraphernalia,
- Tampering With Physical Evidence and
- Possession of Drug Paraphernalia. Defendant was not present and a bench warrant to be issued.
Carlos Hayes, 50 was on the docket for a status hearing on Receiving Stolen Property and Persistent Felony Offender, 2nd degree. The defendant was not present and a bench warrant was issued.
Stephanie Martin, 46 was on the docket for a Probation Revocation Hearing. The defendant’s pretrial diversion was set aside, defendant was released from custody and sentenced to
- 3 years probation and time served on other 2 charges. Charges were not noted on docket.
William McCoy, 46 was arraigned on
- Receiving Stolen Property,
- Possession of a Controlled Substance, methamphetamine and
- Persistent Felony Offender. Pretrial set for 9/28/19.
Mark Mollett, 42 was arraigned on
- Complicity Possession Of a Controlled Substance, 1st degree, methamphetamine,
- Complicity Conspiracy to Trafficking In a Controlled Substance and
- Possession of Marijuana. Pretrial set for 9/28/18.
James Moore, 67 was present for a Probation Revocation Hearing on 2 cases, a hearing was held with witness Billy Slone of Probation and Parole and sentencing was reset for 9/28/18.
Robert Powers, 25 was present for a motion to withdraw Engaging In Organized Crime charge and the motion was Granted.
Kaitlyn Riner, 24 was arraigned on
- Complicity Possession of Controlled Substance, 1st degree, methamphetamine, and
- Complicity Possession of Drug Paraphernalia. Bond was changed to a PSAP placement (PSAP is a substance abuse treatment) Pretrial set for 9/28/18.
John Scott, 32 was present on a status hearing for Possession of Controlled Substance, methamphetamine. Parties stipulates to report that the defendant is not competent to stand trial. The case was dismissed.
Brett Thomas, 28, a hearing is set for 9/17/18 and no charges were listed on docket.
James Vanhoose, 39 was set for a trial date for 2/4/19 with a report date of 1/11/19 on
