The Lawrence County Grand Jury hands down 7 Indictments for the month of February.
Shirley Vincell, 28 from Louisa, Ky. Indicted on Bail jumping in the 1st, a class D felony that carries a penalty of 1 to 5 years.
The grand jury charges that on January 13, 2017 in Lawrence County Kentucky that Shirley Vincell committed the offense of bail jumping by knowingly and unlawfully having been released from custody by the court, with or without bond, upon condition that she would subsequently appear at a specified time and place in connection with felony charges of Manufacturing Methamphetamine and Tampering with Physical Evidence, she failed to appear at that time and place as ordered by court.
Todd Fitzpatrick, 21 of Louisa, Ky. Indicted indicted on Custodial Interference a class D felony with a penalty of 1 to 5 years.
The grand jury charges that from on or about January 9, 2017 to January 10, 2017 in Lawrence county Kentucky, the defendant committed the offense by knowingly and unlawfully taking, enticing or keeping a juvenile child, 17 years of age from lawful custody.
Matthew Caudill, 35 of Louisa, Ky. Indicted on Bail jumping 1st degree, a class D felony that carries a sentence of 1 to 5 years.
The grand jury charges that on January 13, 2017 in Lawrence County Kentucky, Matthew Caudill committed the offense by knowingly and unlawfully having been released from custody by the court, with or without bail, upon condition that he would subsequently appear at the specified time and place in connection with a felony charge. He failed to appear at that time and place as ordered by the court.
Danny Colegrove, 31 of Lenore, WV has been indicted on Theft by Unlawful Taking over 500 under 10,000 (shoplifting) a class D felony, Persistent Felony Offender in the 1st, an enhancement and Use/Possession of Drug Paraphernalia, a class A misdemeanor.
The Grand Jury Charges that on or about November 25th, 2016, the defendant knowingly and unlawfully took over $500 and under $10,000 (shoplifting) taking 2 XBOX gaming systems valued at $249.00 each, a PlayStation PS4 video gaming system valued at $249.00, a laptop computer valued at $249.00 and tablet at $72.00 from Walmart of Louisa, KY. with the value exceeding $500.00. Having been charged with the instant indictment is now being charged as a persistent felony offender in the 1st° for the reason that the defendant, now more than 21 years of age, was previously convicted of two prior felonies when he was at least 18 years of age. The defendant also committed the offense of possession/use drug paraphernalia by knowingly and and unlawfully being in possession of a syringe.
Stephanie Fletcher, 35 of Louisa, KY. Was indicted on the charges of Burglary In The 2nd Degree, a class C felony with a penalty of 5 to 10 years and Theft By Unlawful Taking Over $500.00, a class D felony with a penalty of 1-5 years.
The grand jury charges that on or about March 22, 2016 in Lawrence county Kentucky, the defendant knowingly and unlawfully entered the dwelling house of Mr. Jesse Curry of Louisa Kentucky with the intent to commit the crime of theft. The defendant committed the offense of theft by knowingly and unlawfully taking seven fishing poles and reels one ABU Garcia bait caster reel, a ABU Garcia closed face reel, a Mitchell reel, two Zebco reels, and 19 inch Sony TV, a Sony DVD player, a gallon jug with $150 worth of coins, 20 ounces of silver, a 5 ounce bar of silver, 14 silver rounds, 20 (10 Graham bars of silver.) and an outdoor refrigerator owned by Mr. Curry of Louisa Kentucky with a total value of stolen items at $1258. Bond is set at $10,000.
Timothy Scott, 43 of Fallsburg, KY was indicted on Distribution of Matter Portraying A Sexual Performance By A Minor, a class D felony with a penalty of 1-5 years and Possession of Matter Portraying A Sexual Performance By A Minor.
The grand jury charges that from a period beginning on October 4, 2016 and ending on January 23, 2017 in Lawrence County Kentucky, the above named defendant committed the offense of distribution of matter portraying a sexual performance by minor by having knowledge of its content or characters sent into the state for sale or distribution, while in this state he exhibited the matter for profit or game, be in its position of this matter with intent to distribute, exhibit for profit or gains or to offer to distribute any matter portraying a sexual performance by a minor. The defendant committed the offense of Possession of Matter of Portraying a Sexual Performance by a minor by having knowledge of its content or character sent or caused to be sent into the state for sale or distribution, while in this state he exhibited the matter for profit or gain, for distribution or offer a distribution for having been in possession of this matter with intent to distribute, exhibit for profit or gain were to offer to distribute any matter portraying a sexual performance by a minor. Bond set for $5000.
James Gartin, 54 (AKA Jimmy Gartin) of Ashland, KY. Indicted on charges of Rape In The First Degree (Victim under 12 years of age) A class A felony with a penalty of 20 to 50 years, and 2 Counts of Sodomy In The First Degree (victim and her 12 years of age) a class A felony with a penalty of 20-50 years.
The Grand Jury Charges that on or before January 13, 2016 through January 13, 2017 in Lawrence County Kentucky the above named defendant knowingly and unlawfully committed the offense of Rape in the 1st° against a vulnerable victim in a continuing course of conduct by engaging in sexual intercourse with a victim under the age of 12 years old, two or more times between January 2016 and Jan. 2017. The defendant James Gartin committed the offense of Sodomy in the 1st° by knowingly and unlawfully committing the offense against a vulnerable victim in a continuing course of conduct by engaging in deviant sexual intercourse with a victim less than 12 years of age 2 or more times between January 2016 and January 2017. Bond set at $25,000.
