LOUISA, Ky. — A six year-old sustained serious injury after an accident at ‘The Cove’, a recreational facility at Yatesville Lake operated for profit by the Lawrence County fiscal court and county employee Suzie New, who is the manager of ‘The Cove’, a lawsuit filed April 3 says.
The lawsuit states the facility was not properly supervised when the accident happened.
Six year old Rox Bowen suffered head injuries when he butted heads with an adult female coming down a inflatable slide. Rox and his mother, Sasha Dotson filed the lawsuit over the incident which took place on June 6, 2023.
Also named in the lawsuit is “unnamed defendants’ but no information as to the identity of the unknown defendants was given in the lawsuit filed by Jason C. Reichenbach of Paintsville and E. Seth Combs of Hindman. It is expected to be other employees of the county or of the facility.
The suit calls ‘The Cove’ a “quasi-governmental entity operated for profit” by Lawrence County. The suit names Ms. New individually as the pool manager for negligence and lack of training of the staff at the facility. She is also owner of two cabins with two more on the way near ‘The Cove’.
‘The Cove’ has become a popular playground in the past two years for local citizens as well as tourists from all over. This is the first serious accident reported. The suit says Rox Bowen has permanent disfigurement, mental health problems, pain and anguish, medical expenses, and four other similar pain and anguish injuries, the lawsuit says.
A spokesperson at the Lawrence County judge’s office said the county’s insurance provider is KACO.
