LAWRENCE COUNTY, KY GRAND JURY RETURNS CHARGES MARCH 14

A Lawrence County Grand Jury returned the following criminal indictments on March 14, 2024.

Commonwealth of Kentucky vs. Cyril Derrico

The Commonwealth Attorney charges: that on or before November 12th, 2023, in Lawrence County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Cyril Derrico committed the offense of trafficking in a controlled substance in the 1st degree (Methamphetamine) by knowingly and an unlawfully being in possession of approximately 2.39 grams of methamphetamine in two plastic baggies and two sets of digital scales, with the intent to traffic in that methamphetamine or by trafficking in that 2.39 grams of methamphetamine while in possession of a .380 caliber handgun.

2. That the defendant, having been charged in the instant indictment with the above stated felony count (s), is now being charged as a Persistent Felony Offender, in the 1st Degree.

3. The above-named defendant committed the offense of Operating a Motor Vehicle while Under the Influence of Alcohol/Drugs 1st Offense within 5 years by operating a motor vehicle while under the influence of alcohol or other substances that impair a driver’s ability to operate that motor vehicle.

4. The above-named defendant committed the offense of Possession Drug Paraphernalia by knowingly and unlawfully being in possession of an altered glass pipe.

5. The above-named defendant committed the offense of Possession of Marijuana by knowingly and unlawfully being in possession of marijuana.

6. The above-named defendant committed the offense of Operating a Motor Vehicle on Suspended or Revoked License by knowingly and unlawfully operating a motor vehicle while his license to operate said motor vehicle had been suspended or revoked.

7. The above-named defendant committed the violation of No Registration Plates by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway without proper registration plates as defined in KRS: 186. 170.

8. The above-named defendant committed the violation of No/Expired Registration Plates by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway without proper registration plates as defined in KRS: 186. 170.

9. The above-named defendant committed the violation of Failure to Produce Insurance Card by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway without possession of a proper insurance card as defined and required in KRS: 304. 39 – 117.

10. The above-named defendant committed the violation of Careless Driving by knowingly and unlawfully operating a motor vehicle upon a Kentucky roadway without regard for the safety and convenience of pedestrians, and other vehicles on highway.

Commonwealth of Kentucky vs. Cyril Derrico

The Commonwealth Attorney charges: that on or before November 12th, 2023, in Lawrence County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Cyril Derrico committed the offense of Possession of a Firearm by a Convicted Felon by being in possession of a Lorcin Engineering Co. .380 caliber handgun after having being previously convicted of a felony (State of West Virginia vs Cyril Derrico, Wayne County, 03-F-048 and 09-F-140).

2. That the defendant, having been charged in the instant indictment with the above stated felony count (s), is now being charged as a Persistent Felony Offender, in the 1st Degree.

Commonwealth of Kentucky vs. Hansel Wiley

The Commonwealth Attorney charges: that on or before November 8th, 2023, in Lawrence County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Hansel Wiley committed the offense of Trafficking in a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of approximately .101 grams, with the intent to traffic in that Methamphetamine or by trafficking in that .101 grams of Methamphetamine.

 

Commonwealth of Kentucky vs. Charles French

The Commonwealth Attorney charges: that on or before June 7th, 2023, in Lawrence County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Charles French committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a controlled substance, Methamphetamine.

Commonwealth of Kentucky vs. Joseph Chapman

The Commonwealth Attorney charges: that on or before June 2nd, 2023, in Lawrence County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Joseph Chapman committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a controlled substance, Methamphetamine.

Commonwealth of Kentucky vs. Jonathan Coleman, Jr.

The Commonwealth Attorney charges: that on or before September 10th, 2023, in Lawrence County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Jonathan Coleman, Jr., acting alone or in complicity with Brittany Coleman, committed the offense of Criminal Abuse in the 2nd Degree by knowingly, unlawfully, and wantonly abusing, and/or permitting another person of whom she had actual custody to so abuse, a person less than 12 years of age, namely W.C., and thereby placing him in a situation that may cause her serious physical injury.

Commonwealth of Kentucky vs. Brittany Coleman

The Commonwealth Attorney charges: that on or before September 10th, 2023, in Lawrence County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Jonathan Coleman, Jr., acting alone or in complicity with Jonathan Coleman, committed the offense of Criminal Abuse in the 2nd Degree by knowingly, unlawfully, and wantonly abusing, and/or permitting another person of whom she had actual custody to so abuse, a person less than 12 years of age, namely W.C., and thereby placing him in a situation that may cause her serious physical injury.

Commonwealth of Kentucky vs. Jennifer Patton

The Commonwealth Attorney charges: that on or before January 1st, 2024 in Lawrence County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Jennifer Patton committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a Controlled Substance, namely 1.576 grams of Methamphetamine.

2. The above-mentioned committed the offense of Possession/Use Drug Paraphernalia by knowingly and unlawfully being in possession of numerous syringes and a set of digital skills, a glass pipe containing residue and hypodermic needles.

3. The above-named defendant committed the offense of Prescription Controlled Substance Not in the Proper Container by knowingly and unlawfully being in possession of 4 Buprenorphine and Naloxone strips not in the proper administered container.

Commonwealth of Kentucky vs. Jose Morales

The Commonwealth Attorney charges: that on or before September 18th, 2023, in Lawrence County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Jose Morales committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a Controlled Substance,

2. The above-named defendant committed the offense of Operating a Motor Vehicle While Under the Influence of Alcohol/Drugs 2nd Degree Offense within 10 years by operating a motor vehicle while under the influence of alcohol or other substances that impair a driver’s ability to operate that motor vehicle, while having a previous conviction of KRS: 189a.101 within the last 10 years, Floyd District Court, 23-T-01382.

3. The above-named defendant committed the violation of Open Alcohol Container in a Motor Vehicle by knowingly and unlawfully having 2 open alcohol containers in a motor vehicle while the motor vehicle was being operated on a Ketnucky roadway.

Commonwealth of Kentucky vs. Rae Jackson

The Commonwealth Attorney charges: that on or before March 1st, 2024, in Lawrence County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Rae Jackson committed the offense of Wanton Endangerment in the 1st Degree by knowingly and unlawfully engaging in conduct which created a substantial  danger to another, namely a 7 month old juvenile child.

2. That the defendant, having been charged in the instant indictment with the above stated felony count (s), is now being charged as a Persistent Felony Offender, in the 1st Degree.

3. Rae Jackson defendant committed the offense of Operating a Motor Vehicle While Under the Influence of Alcohol/Drugs 1st Offense within 10 years by operating a motor vehicle well under the influence of alcohol or other substances that impair a driver’s ability to operate that motor vehicle, with two prior convictions of 189A.010, Carter District Court 21-T-00444 and 20-T-1968.

4. The above- named defendant committed the offense of Operating a Motor Vehicle on Suspended or Revoked License by knowingly and unlawfully operating a motor vehicle while his license to operate said motor vehicle had been suspended or revoked.

Commonwealth of Kentucky vs. Christopher Fowler

The Commonwealth Attorney charges: that on or before December 4th, 2023, in Lawrence County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Christopher Fowler committed the offense of Possession of a Controlled Substance in the 1st Degree by knowingly and unlawfully being in possession of a Controlled Substance, namely 1.576 grams of Methamphetamine.

2. The above- named defendant committed the offense of Operating a Motor Vehicle on Suspended or Revoked License by knowingly and unlawfully operating a motor vehicle while her license had been suspended or revoked.

3. The above-named defendant committed the offense of Possession of Marijuana by knowingly or unlawfully possessing marijuana.

4. The above-named defendant committed the violation of All Terrain Vehicle Violations by being in physical control of an ATV and operating that ATV upon a Kentucky roadway.

Commonwealth of Kentucky vs. Jeffrey Napier

The Commonwealth Attorney charges: that on or before February 23rd, 2024, in Lawrence County, Kentucky, and before the finding of the indictment herein, the above-named defendant:

1. Jeffrey Naper committed the offense of Assault in the 3rd Degree by assaulting or attempting to assault Emergency Room Nurse, Erin O’Bryan with Three Rivers Medical Center while acting in her official capacity.

2. Jeffrey Naper committed the offense of Assault in the 3rd Degree by assaulting or attempting to assault Patriot Emergency Medical Service employee, Harley Pauley while acting in her official capacity.

3. Jeffrey Naper committed the offense of Assault in the 3rd Degree by assaulting or attempting to assault Emergency Room Nurse, Kelsey Howard with Three Rivers Medical Center while acting in her official capacity.

4. Jeffrey Naper committed the offense of Assault in the 3rd Degree by assaulting or attempting to assault Emergency Room Nurse, Allison Isaac with Three Rivers Medical Center while acting in her official capacity.

5. Jeffrey Naper committed the offense of Assault in the 3rd Degree by assaulting or attempting to assault Deputy Joe Osborne with the Lawrence COunty Sheriff’s Department while acting in his official capacity.


6. The above-named defendant committed the offense of Resisting Arrest by knowingly and unlawfully disregarding deputy Joe Osborne with the Lawrence County Sheriff’s Department’s verbal commands while preventing the Officer, while working in his official capacity, from placing the defendant under arrest.
