Martin County Grand Jury Indictments

Commonwealth vs. Joy Armes

The Grand Jury charges that on or before December 4, 2019 in Martin County, Ky, the above named defendant:

1. Joy Armes committed the offense of trafficking in a controlled substance in the first degree by knowingly and unlawfully being in possession of 1.9 grams of Methamphetamine, $807.00 in cash and digital scales, with the intent to traffic in that Methamphetamine, or by trafficking in that said Methamphetamine.

Commonwealth vs. Kristie Nichols

The Grand Jury charges that on or before January 7, 2020 in Martin County, Ky, the above named defendant:

1. Kristie Nichols acting alone or in complicity with Jenious Maynard committed the offense of trafficking in a controlled substance in the first degree by knowingly and unlawfully being in possession of 0.297 grams of Methamphetamine, digital scales, and syringes, with the intent to traffic in that Methamphetamine, or by trafficking in that said Methamphetamine.

2. The above named defendant acting alone or in complicity with Jenious Maynard committed the offense of possession of drug paraphernalia by knowingly and unlawfully being in possession of two altered pipes.

Commonwealth vs. Fred Daniels

The Grand Jury charges that on or before January 30, 2020 in Martin County, Ky, the above named defendant:

1. Fred Daniels committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of a controlled substance, Methamphetamine.

2. The above named defendant committed the offense of possession drug paraphernalia by unlawfully and unlawfully being in possession of an alerted pipe.

3. The above named defendant committed the offense of driving DUI suspended license, first offense by knowingly and unlawfully operating a motor vehicle while his operators license had been suspended for a violation

The Grand Jury charges that on or before January 29, 2020 in Martin County, Ky, the above named defendant:

1. Arthur Jude committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of a controlled substance, Methamphetamine.

2. The above named defendant committed the offense of possession of drug paraphernalia by knowingly and unlawfully being in possession of an altered spoon.

The Grand Jury charges that on or before January 29, 2020 in Martin County, Ky, the above named defendant:

1. Sinead McGinnish committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of a  controlled substance, Methamphetamine.

2. The above named defendant committed the offense of possession of drug paraphernalia by knowingly and unlawfully being in possession of a syringe.

The Grand Jury charges that on or before January 7, 2020 in Martin County, Ky, the above named defendant:

1. Jenious Mayard acting alone or in complicity with Kristie Nichols committed the offense of trafficking in a controlled substance in the first degree by knowingly and unlawfully being in possession of 0/297 grams of Methamphetamine, digital scales and syringes, with the intent to traffic in that Methamphetamine, or by trafficking in that said Methamphetamine.

2. The above named defendant acting alone or in complicity with Kristie Nichols committed the offense of possession of drug paraphernalia by knowingly and unlawfully being in possession of two altered pipes.

Commonwealth vs. Ricky Pauley

The Grand Jury charges that on or before January 29, 2020 in Martin County, Ky, the above named defendant:

1. Ricky Pauley committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of a controlled substance, Methamphetamine.

2. The above named defendant committed the offense of possession of drug paraphernalia by knowingly and unlawfully being in possession of a syringe.

3. The above named defendant committed the offense of public intoxication by knowingly and unlawfully being in a public setting manifestly under the influence of controlled substance.

 

Commonwealth vs. Ricky Pauley

The Grand Jury charges that on or before December 31, 2019 in Martin County, Ky, the above named defendant:

1. Ricky Pauley acting alone or in complicity with Amanda Kirk committed the offense of possession of a controlled substance in the 1st degree by knowingly and unlawfully being in possession of a controlled substance, Methamphetamine.

2. The above named defendant acting alone or in complicity with Amanda Kirk committed the offense of possession of drug paraphernalia by knowingly and unlawfully being in possession of four syringes.

3. The above named defendant committed the offense of resisting arrest by knowingly, intentionally and unlawfully attempting to prevent Constable Tony Preece from effecting an arrest by using or threatening to use physical force against said police officers.

4. The above named defendant committed the offense of disorderly conduct in the second degree by knowingly and unlawfully engaging in violent or threatening behavior in a public place with the intent to cause public inconvenience, annoyance, and/or alarm.

1. Ricky Pauley acting alone or in complicity with Amanad Kirk committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of a controlled substance, Methamphetamine.

2. The above named defendant acting alone or in complicity with Amanda Kirk committed the offense of possession of drug paraphernalia by knowingly and unlawfully being in possession of two syringes.

1. Amanda Lynn Kirk acting alone or in complicity with Ricky Pauley committed the offense of possession of a controlled substance in the first degree by unlawfully being in possession of a controlled substance, Methamphetamine.

2. The above named defendant acting alone or in complicity with Ricky Pauley committed the offense of possession of drug paraphernalia by knowingly and unlawfully being in possession of two syringes.

Commonwealth vs. Shannon Ray Justice

The Grand Jury charges that on or before January 8, 2020 in Martin County, Ky, the above named defendant:

1. Shannon Ray Justice acting alone or in complicity with Whitley Perry, committed the offense of receiving stolen property over $500.00 but under $10,000.00 by knowingly and unlawfully being in possession of two televisions and a laptop computer stolen from Leah May of Inez, Ky with a value of the stolen items exceeding $500.00.

2. The above named defendant committed the offense of possession/use of drug paraphernalia by knowingly and unlawfully being in possession of an altered pipe.

Commonwealth vs. Whitley Perry

The Grand Jury charges that on or before January 8, 2020 in Martin County, Ky, the above named defendant:

1. Whitley Perry acting alone or in complicity with Shannon Justice  committed the offense of receiving stolen property over $500.00 but under $10,000.00 by knowingly and unlawfully being in possession of two televisions and a laptop computer stolen from Leah May of Inez, Ky with a value of the stolen items exceeding $500.00.

Commonwealth vs. Tammy Renee Allen

The Grand Jury charges that on or before March 23, 2020 in Martin County, Ky, the above named defendant:

1. Tammy Renee Allen acting alone or in complicity with Vince Allen committed the offense of theft by unlawful taking over $500.00 but under $10,000.00 by knowingly and unlawfully taking a roll of copper wire from AEP with a value of $500.00.

The Grand Jury charges that on or before February 26, 2020 in Martin County, Ky, the above named defendant:

1. Mary E. Jude committed the offense of possession of a controlled substance in the first degree by knowingly and unlawfully being in possession of a controlled substance, Methamphetamine.

2. The above named defendant committed the offense of possession of drug paraphernalia by knowingly and unlawfully being in possession of a syringe.

The Grand Jury charges that on or before March 23, 2020 in Martin County, Ky, the above named defendant:

1. Vince Allen acting alone or in complicity with Tammy Renee Allen committed the offense of theft by unlawful taking over $500.00 but under $10,000.00 by knowingly and unlawfully taking a roll of copper wire from AEP, with a value of $500.00.

The Grand Jury charges that on or before December 31, 2019  in Martin County, Ky, the above named defendant:

1. Charles Casey Booth committed the offense of use of a minor in a sexual performance by inducing the minor to engage in a sexual performance with another minor under the age of 16 years of age to engage in a sexual performance.

2. The above named defendant committed the offense of prohibited use of electronic communication system to procure or promote the use of a minor regarding sexual offenses by knowingly and unlawfully using a communication system, including computers and cellular telephones, for the purpose of procuring or promoting the use of a minor in an activity that violates Chapter 531 of the Kentucky Penal Code.

3. The above named defendant committed the offense of prohibited use of electronic communication system to procure the use of a minor regarding sexual offenses by knowingly and unlawfully using a communication system, including computers and cellular telephones, for the purpose of procuring or promoting the use of a monir in an activity that violates KRS 510.040.

4. The above named defendant committed the offense of prohibited use of electronic communication system to procure or promote the use of a minor regarding sexual offenses by knowingly and unlawfully using a communication system including computers and cellular telephone, for the purpose of procuring or promoting the use of a minor in an activity that violate KRS 510.040.

5. The above named defendant committed the offense of possession or viewing of matter portraying a sexual performance by a minor by knowingly having in his possession or control and/or intentionally viewing matter which visually depicted an actual sexual performance by a minor person with knowledge of its content, character namely a file shared through Facebook of an prepubescent female with private area(s) exposed in a sexual manner.

6. The above named defendant committed the offense of possession or viewing of matter portraying a sexual performance by a minor by knowingly having in his possession or control and/or intentionally viewing matter which visually depicted an actual sexual performance by a minor person with knowledge of its content, character namely a file shared through Snapchat of an prepubescent female with private area(s) exposed in a sexual manner.

7. The above named defendant committed the offense of possession or viewing of matter portraying a sexual performance by a minor by knowoingly having in his possession or control and/or intentionally viewing matter which visually depicted an actual sexual performance by a minor person with knowledge of its content, character namely a file shared through Snapchat of an prepubescent child in a red dress engaging in oral sex on a male with private area(s) exposed.

Commonwealth vs. Chad A. Nichols

The Grand Jury charges that on or before August 6, 2019  in Martin County, Ky, the above named defendant:

1. Chad A. Nichols committed the offense of fleeing or evading police in the first degree by knowingly and unlawfully by operating a motor vehicle with the attempt to elude or fell Deputy Paul McCoy with the Martin County Sheriff’s Department, while acting in his official capacity as a police officer.

2. Chad Nichols committed the offense of escape in the second degree by knowingly and unlawfully escaping the custody of Deputy Paul McCoy with the Martin County Sheriff’s Department.

3. Chad Nichols committed the offense of wanton endangerment in the first degree by knowingly and unlawfully engaging in conduct which created a substantial danger to another, namely Deputy Paul McCoy with the Martin County Sheriff’s Department.

4. That the defendant having been charged in the instant indictment with the above state felony count(s) is now being charged as a persistent felony offender in the first degree.

Commonwealth vs. Mardy Mollett Jr.

The Grand Jury charges that on or before March 13, 2020  in Martin County, Ky, the above named defendant:

1. Mardy Mollett Jr. committed the offense of burglary in the first degree by knowingly and unlawfully entering the dwelling house of Pamlea Blevins of Tomahawk, Ky with the intent to commit a crime of assault.

2. Mardy Mollett Jr. committed the offense of assault in the second degree by intentionally or wantoly assaulting Pamela Blevins, causing physical injury by means of a deadly weapon or instrument.

3. Mardy Mollett Jr. committed the offense of criminal mischief in the first degree by knowingly and unlawfully damaging property owned by Pamela Blevins of Tomahawk, Ky with damages exceeding $1,000.00

4. The above named defendant committed the offense of cruelty to animals by knowingly and unlawfully subjected an animal to or cause curel or injurious treatment.

 

Commonwealth vs. Mardy Mollett

The Grand Jury charges that on or before March 13, 2020  in Martin County, Ky, the above named defendant:

1. Mardy Mollett committed the offense of possession of a firearm by a convicted felon by being in possession of a handgun used in the shooting of a dog belonging to Pamela Blevins after having been previously convicted of a felony.

1. Mardy Mollett committed the offense of possession of a firearm by a convicted felon by possessing a .45 caliber GMF (Guardian Manufacturing Corporation) brand handgun after having been previously convicted of a felony.

The Grand Jury charges that on or before March 16, 2020  in Martin County, Ky, the above named defendant:

1. Mardy Mollett, committed the offense of trafficking in a controlled substance in the first degree by knowingly and unlawfully being in possession of 28.766 grams of Methamphetamine with the intent to traffic in that Methamphetamine or by trafficking the 28.776 grams of Methamphetamine.

2. Mardy Mollett committed the offense of trafficking Marijuana (more than five pounds) by knowingly and unlawfully being in possession of approximately 3.9 ounces (112 grams) of Marijuana with the intent to traffic in that 3.9 ounces of Marijuana.

1. Charles S. Fletcher committed the offense of receiving stolen property/under $10,000 by knowingly receiving and being in possession of two Honda motors belonging to the Blue Flame Energy Corporation.

2. The above named defendant acting alone or in complicity with Kelli L. Dials committed the offense of possession of drug paraphernalia by knowingly and unlawfully being in possession of digital scales, a homemade copper pipe, and a blue and silver pipe.

2. The above named defendant acting alone or in complicity with Jeffrey Stanley committed the offense of possession of drug paraphernalia by knowingly and unlawfully being in possession of digital scales, a homemade copper pipe, and a blue and silver pipe.

1. Latasha Delong committed the offense of assault in the third degree by assaulting or attempting to assault Deputy David Adams with the Martin County Sheriff’s Department while acting in his official capacity.

1. Donald R. Delong committed the offense of assault in the third degree by assaulting or attempting to assault Deputy David Adams with the Martin County Sheriff’s Department while acting in his official capacity.
